What the law and the card networks now require from AI companions

AI companions moved from a grey zone into explicit rules. A platform that ignores them risks its merchant account before it risks a fine.

Tell users they are talking to AI
The EU AI Act (Article 50) requires people to be informed when they interact with an AI system. California's companion chatbot law (SB 243) requires a clear notice when a reasonable person could mistake the bot for a human, repeated reminders for known minors, and a protocol for self-harm conversations.
Verify age before explicit content
The UK Online Safety Act requires highly effective age assurance for services that can produce pornographic content, and Ofcom has opened an investigation into an AI companion service. In the US, the Supreme Court upheld Texas's age verification law, and similar laws exist in a large number of states.
Pass the card networks
Mastercard requires adult merchants to be registered through the acquirer, with age and identity verification and content review. Visa treats adult content, including AI-generated, as a high-risk category with acquirer registration. Stripe does not accept adult content at all, AI-generated included.
Pass the app stores
Apple prohibits overtly sexual content and expects AI content apps to filter output, accept reports, and block users. Google Play's policy on AI-generated content covers text chatbots and prohibits the generation of prohibited sexual content.

Self-hosted Llama-3 70B fine-tuned for NSFW dialogue (default). Mixtral 8x22B variant available. On-prem: BYOK model option for buyers who must self-host.
Will it pass payment-processor compliance?
Yes - age-gate before first explicit reply, content classification on every turn, audit log per session. Compatible with CCBill, Verotel, SegPay merchant requirements (v3.2 / 2026).
How is voice cloning licensed?
Per-creator: creator records 90s sample, signs licensing terms (template provided). Platform owns voice rights, royalty pass-through to creator is optional. Persona inherits voice.
Can we use our existing tip / sub system?
Yes - Pro tier: webhooks bridge persona tier-change to your existing billing. Standard tier: bring your tip/sub system, persona tier API consumes events from anywhere.
